Drug convicts’ jail terms upheld

The Fujairaj Court of Appeal on Tuesday upheld a lower court’s verdict sentencing two Arab nationals to four years in prison each for drug abuse.

According to court records, the incident happened in April this year, when the Anti-Narcotics Department of the Fujairah Police was tipped off that two Arab nationals were taking drugs and selling hashish to youth at a cafe in the city. Police made investigations and confirmed the authenticity of the information.A trap was laid and the pair was arrested. Less than 2 grams of hashish were found in their possession.

The defendants, 26-year-old A.M. and 29-year-old T.A., were referred to the Public Prosecution which accused them of drug pushing and abuse. They denied the charges of drug pushing but confessed to consuming drugs.

Samples of their urine tested positive for drug use.

They were referred to the Court of First Instance. The defence argued that the narcotic substance recovered from their possession was a small amount and it was not meant for selling but for their consumption only. The court sentenced each of them to four years in jail, ruling that there was no conclusive evidence that the pair had sold the contraband to youth. The convicts contested the verdict but Presiding Judge of the Court of Appeal bench Abdullah Al Salami turned down their petition and upheld the lower court’s ruling.— news@khaleejtimes.com
