The Ras Al Khaimah Court of Appeal has reduced the Dh3,000 fine, earlier ruled by the lower court against a woman, to Dh1,000.
The woman, a GCC national, was found guilty of damaging the door of her husband's house following family disputes.
Court records show the case unfolded when the wife filed a lawsuit against her husband seeking divorce for repetitive physical and emotional harms and abuses.
"He used to beat me up all the time," she told the court. She added that she was at the hospital during the night of the alleged incident. "I was getting a medical report that proved I was assaulted and bled while I was pregnant."
Upon returning home, she discovered that her husband had locked her out (as claimed by her husband). "She damaged the house door and broke into the house to take her children with her," he told the court.
The husband approached the RAK Police and lodged a complaint against his wife charging her of breaking the door of his house. The wife was summoned, interrogated and referred to the public prosecution.
The case was moved to the misdemeanour court, where she denied all the charges, affirming that the door was already broken.
The defence lawyer told the court that the husband's allegations are fake and baseless considering ongoing family disputes documented in the court of personal status, along with a divorce case.
She added that the house door was already broken. "My client went home to take her children who are in her custody."
The husband refused all attempts of reconciliation and insisted on taking his wife to the court on 'fabricated' charges.
