Trivandrum: A special court of National Investigation Agency (NIA) in Kerala on Monday sentenced two convicts in the case related to a secret meeting organised by the outlawed Students Islamic Federation of India (Simi) at Panayikulam near Alwaye in Ernakulam district to 14 years rigorous imprisonment and three others to 12 years.
The court also imposed fine of Rs60,000 each on first and accused and Rs 55,000 each on third, fourth and fifth accused. The court had on November 25 convicted the five under various sections of Indian Penal Code (IPC) and Unlawful Activities (Prevention) Act and acquitted 11 others.
While the second accused Abdul Rasik and third accused Ansar Nadvi were found guilty of sedition, the first, fourth and fifth P.A. Shaduly, Nizamuddin Shammin respectively were convicted under Section 120 (b) (criminal conspiracy).
The sentences shall run consecutively with the result, the accused 1 and 2 will have to undergo substantive sentence of 14 years each and the accused 3,4 and 5 will have to undergo a substantive sentence of 12 years each," it ruled.
Additional District and Sessions Court Judge K M Balachandran denied the benefit of concurrent running of case. The court also rejected the plea of the counsel for the accused the benefit of Probation of Offenders Act, saying that the offences committed by them were against the nation.
The judge ruled that the sentences shall run consecutively with the result. This means that the accused 1 and 2 will have to undergo substantive sentence of 14 years each and the accused 3, 4 and 5 will have to undergo a substantive sentence of 12 years each. The period of remand undergone by them would be set off. Hailing the verdict, NIA prosecutor P G Manu said the court had awarded maximum sentences to the convicted who have been found guilty of anti-national activities. The counsel for the convicts said they will go in appeal against the verdict.
The police had arrested the convicts following a raid at an auditorium at Panayikulam.
