Pursuant to the resolution, the committee shall include consultants from different medical specialisations and other specialities as the cabinet may deem necessary.

The cabinet shall also resolve to name the committee’s chairman, vice chairman and members.

The resolution, published in the Official Gazette, states that the committee is competent to provide technical opinion in case of medical errors, establish conditional relevance and occupational hazards. The committee shall practice its competencies under instructions from the Federal entities authorised by the Minister of Health or whoever he may delegate from the Ministry of Health, the concerned court and/or the public prosecutor.

The resolution limits the membership in the committee to renewable three years; Article (5) of the resolution states that the committee shall operate from the Ministry of Health’s facilities.

The Higher Committee for Medical Liability shall enjoy independent operational budget, part of the Ministry of Health’s budget, subject to the government regulations.

The new resolution shall overwrite the Cabinet Resolution No 31 for the year 2009.
