The Ras Al Khaimah Criminal Court of Appeal has upheld the life sentence of two gulf nationals convicted of kidnapping and raping a youth. Another accused was ordered to serve five years in prison.
The defendants, also found guilty of recording their crime and threatening to share the same on social media, were ordered to move out at least 5km off the house of the victim.
As per court records, the first and second defendants decided to take revenge on the victim, who allegedly spread some shameful stories about them. One of them invited the victim to have a chat, to which the latter agreed. When they met, they drove him to a remote desert area and pushed him out of the car. All the three accused then shot him in his right hand and left shoulder, using stun guns.
The third suspect also stabbed the victim in his right hand and the trio beat him up severely.
The first and second accused took turns to rape the victim, while the third suspect stood there watching. The victim was then moved to a farm owned by the first defendant, where he was raped again. The crime was shot by the defendant who threatened the victim to share the video on social media if the victim told anyone about their crime.
The RAK Police arrested the suspects and referred them to the public prosecution which charged them with kidnapping, beating, insulting and raping the victim, videorecording their crime, and threatening to disgrace him by sharing the video online.
The RAK Criminal Court of First Instance found the first and second defendants guilty and sentenced them to life in prison, while the third suspect was ordered to serve five years in prison, particularly as he is still under the age of 20.
The case was moved to the appeal court which upheld the ruling of the lower court, stating that the first and second suspects would have been sentenced to death if the judges unanimously agreed on the same.
