The woman was charged with premeditated murder of her baby boy born out of an illicit affair. Right after giving birth in a bathroom attached to her room, the woman strangled the baby with her underwear, hid the body in a plastic bag and kept it inside a wardrobe, according to the prosecution.
The crime came to light when she visited a hospital soon after because of tiredness and the doctors found out that she had given birth recently.
Asked about the baby, she claimed that he was stillborn and she threw the body in a garbage container.
The police, who were called in, could not find the body in the container mentioned by her. On searching her room, the baby was found dead in the cupboard.
Before the Court of First Instance, the woman said she felt tired soon after delivery and lost consciousness. During that time, the baby’s head somehow got stuck in her underwear which got wrapped around the baby’s neck, killing him.
She claimed that she kept the baby’s body in her wardrobe so that she could take it to her home country later to let his legal father see the body before burial.
However, the forensic doctor who examined the body said in his report that he found the underwear tied so tightly around the baby’s neck that he could not untie the knot. He had to use scissors to release the noose.
Based on this report and other evidence, the Court of First Instance convicted her of premeditated murder and sentenced her to life imprisonment and deportation later.
She challenged the verdict at the appellate court, reiterating her earlier claims. She kept telling the court that the baby was stillborn. The court rejected the claims but exercised the principle of mercy and reduced the jail sentence.
