An Arab woman will pay Dh45, 000 in compensation for assaulting a mother in front of her children and causing permanent disability to her left eye.
The Abu Dhabi Civil Appellate Court upheld an earlier ruling of the Court of First Instance that ordered the convicted woman to pay the money to the victim for the material and moral damages she suffered due to the beating.
Official court documents stated that the woman had arrived at the emergency department of a government hospital in Abu Dhabi with cuts on her hands and bruises on her forehead above the left eye, on the neck, and bruises on her upper back. She said she had been beaten up by the defendant in the presence of her children. The reason behind the attack was not mentioned.
The wounds were treated at the hospital but the woman continued complaining of pain in the left eye which had been hit by an object as she was being attacked. The condition of the eye improved later, but her visibility was affected.
A medical report by experts assigned by court said the woman suffered a 10 per cent disability in one of her eyes, resulting from the attack and that it also caused her psychological pain.
The criminal court had convicted the Arab woman of beating the victim and was penalised accordingly.
The victim then filed a civil lawsuit against her demanding Dh450,000 in compensation for physical, moral and material damages.
The civil court of first instance ordered the defendant to compensate the plaintiff Dh45,000 in damages, in addition to paying the legal fees.
Both parties challenged the ruling. The defendant said in her appeal that the doctor's report had some contradictions and that the complainant was suffering from eye disease, especially in the right eye. She added that the bruises above the eye that the report referred to as the cause of the problem had cured in only 21 days after treatment.
She had requested that the amount of compensation be reduced to Dh10,000.
The victim wanted the court to increase the payout determined by the lower court. But the appellate court rejected their appeals and maintained the ruling by the first court.
