The 44-year-old defendant from Denmark was also accused by the Court of First Instance of verbally abusing two men present at the scene.
The accused is believed to have groped the waitress.
The waitress, 29, from Macedonia, said in the investigation that the incident occurred around 6.30pm in July.
She was on duty at the beach club when the defendant came with his friends and sat on a table with no reservations and without ordering any drinks. She told them that it was not allowed. While she was talking to him and his friends, the defendant who was apparently very drunk got closer to her. She moved away from him and was addressing his friends, telling them about the club regulations, when suddenly she was surprised by the accused groping her from behind. She screamed at him and the security guard forced the group out.
The security guard, an Indian, said he was keeping an eye on the accused and his three friends from the moment they entered as they looked drunk.
He saw that they sat on a table even though they had not made any earlier booking. He later saw the accused being pulled out of the swimming pool where he had jumped in his clothes. Later the guard had to take the accused out of the club forcefully when he saw him groping the waitress. The drunk accused resisted him.
A CCTV footage of the incident was provided by the Public Prosecution in the case file as part of the criminal evidence.
