A construction worker, whose foot was amputated due to medical negligence because doctors didn't provide him urgent treatment, has been awarded Dh500,000 in damages.
The Abu Dhabi Court of First Instance ordered the hospital in the Capital and two doctors who treated the Asian patient to pay him the amount. The Asian worker had filed a lawsuit against the hospital and the doctors.
Ali Al Hammadi, the lawyer who represented the worker, said that his client had sustained a simple fracture after falling off the roof of a newly constructed house and went to the hospital seeking emergency treatment. The doctors, according to the lawyer, did not give him any medical attention for almost a day, thinking it was a minor injury. "This caused his injury to deteriorate, leading to the amputation," the lawyer said. "One of the doctors just had a quick visual examination of my client."
Five hours later, the victim asked his employer to come to the hospital so he could help him get proper treatment. When the employer got there, the doctor told him the same thing: that the worker's case did not require serious attention.
They returned to the hospital the next day, when the worker's temperature had risen. They consulted another doctor who said the man's foot had a serious infection and had started to rot. It was too late to treat him now, the doctor said: the worker had needed urgent medical intervention within four hours of sustaining injuries. The lawyer said in the lawsuit that his client should be compensated for the material and physical damage he suffered because he could no longer perform his duties well. The hospital and the two doctors denied any wrongdoing throughout their trial.
