Bahrain orders retrial of medical workers sentenced over unrest

MANAMA — Bahrain will retry 20 medical personnel sentenced last week by the National Safety Court to 5 to 15 years jail terms over crimes including occupying a public hospital during unrest in February and March.

Bahrain’s Attorney-General, Dr Ali Al Buaneen, announced on Wednesday that the Department of Public Prosecutions studied the judgment issued by the National Safety Court, and determined that the cases should be retried before civil courts. The department, the attorney-general said, has the jurisdiction to do so by virtue of its authority to ensure rightful enforcement of the law.

He said that the retrial would be conducted before the highest civil court in Bahrain, as the Department of Public Prosecutions seeks to establish the truth and enforce the law, while protecting the rights of the accused.

During the retrials, the accused will have the benefit of full re-evaluation of evidence and full opportunity to present their defence.

The attorney-general stressed that no doctors or other medical personnel may be punished by reason of the fulfillment of their humanitarian duties or their political views. Pending the outcome of the retrials, the accused shall not be detained.

He added that as a general matter he would continue to assess the judgments of the National Safety Court to ensure compliance with law, and where he deems it appropriate he will move for retrials before the civil judiciary.
