The defendant told Presiding Judge Maher Salama Al Mahdi that he had rented out a flat to the complainant and some other women. That night, he went to the flat to collect the rent of Dh3,000 from the complainant.

According to the prosecution records, the defendant raped the 38-year-old Filipina clerk in January on the kitchen floor after he entered her flat on the pretext of wanting to talk to her about his breakup with her former roommate.

The complainant told the prosecutor that the defendant was her ex-roommate’s boyfriend. That night, he reached her flat around 11pm after he called her on the phone saying he wanted to talk to her about his breakup with her friend and that he was feeling bad. He had been to the flat with her friend earlier.

They talked in the kitchen for about ten minutes after which she asked him to leave as it was getting late and she had work the following day. However, he told her not to make him leave and asked her to hold him tight. Suddenly, he grabbed her hand and pulled her closer to him but she pushed him away. He then pushed her down on the floor and raped her after threatening to beat her up if she screamed even as she was crying hysterically.

After the defendant left, the complainant woke her flat mates up and told them about what happened.

She later told her compatriot ex-roommate, who had an affair with the defendant, to accompany her to the police station if she cared to help her. The 48-year-old ex-roommate, a saleswoman, said the complainant woke her up after midnight and was crying. She told her that the defendant raped her after she let him in to the flat because he wanted to talk to her.

A police lieutenant quoted the defendant as admitting that he raped the woman after the incident was reported to the Rafaa police station. The defendant was arrested shortly later from the same building. According to the report of the General Directorate of Criminal Evidence, the DNA of the semen stains found in the complainant and on her underwear matched with the defendant’s.
