A worker, who stabbed a fellow workmate to death during a fight among several people at their labour accommodation, has been sentenced to five years in jail by the Court of First Instance. He will be deported after completing his jail term.
The 27-year-old Nepalese worker is accused of being drunk on December 20 last year, when he engaged in a fight among labourers which ended in one death. The accused has been detained after the case was reported at Jebel Ali police station.
He claimed that he only meant to scare the victim, and not killing him, when he randomly stabbed him in the chest during the fight.
The defendant denied earlier in court the charge of unintentionally causing the death of a man. He confessed he had consumed liquor prior to the incident.
The other people who got involved in the fight have been referred to the Court of Misdemeanours.
The accommodation supervisor, a Pakistani, said he learned about the incident from a worker around 4.30pm. "When the victim was taken to hospital, he was still alive. By the time I reached there, I found he had died."
The 30-year-old supervisor told the prosecutor that from the accommodation surveillance cameras, it appeared that the victim and the other accused initiated the assault. "They chased after the defendant into his room where the stabbing happened. However, the incident was out of the cameras' ambit.
The workers, including the victim, had gathered near the washroom and planned to attack the defendant. The latter acted in self-defence."
A police lieutenant said the defendant was arrested right after the stabbing was reported at the crime scene.
According to the forensic report, the cause of death was the severe internal haemorrhage. The stabbing was deep and cut through the left lung and the heart. The victim was then under the influence of alcohol.
A footage showing five people kicking and beating a man has been enclosed to the case file.
The defendant can appeal the ruling within 15 days from the issuance date.
