Court orders hospital to pay Dh200, 000

The Abu Dhabi Civil Court of First Instance has ordered two medical bodies in Abu Dhabi to jointly pay a female patient a sum of Dh200, 000 in compensation for the physical and mental harm the patient suffered due to medical negligence.

The woman filed a lawsuit against a hospital, along with the medical entity in charge of running and managing the hospital, demanding a compensation.

In 2007, the woman had a fracture in her left ankle for which she was admitted to the emergency section of the hospital. The doctors recommended surgery and assured her 90 per cent success. She underwent the surgery the next day and was discharged the following day without being given any medicines or being kept under observation. When the woman went back to the hospital to get her stitches removed, she informed the doctors about the excruciating pain. The doctors, however, did not do act on this and allowed her to leave the hospital.

Out of fear, the woman’s family took her to another hospital where doctors advised them to return to the hospital where the patient had undergone the surgery. The woman headed back to the hospital, but the hospital did not give her case the right attention.

A month later, the woman got the steel rod of the fractured ankle removed following a complaint by the woman’s family submitted to the hospital.

The hospital then prepared a technical report about the health condition of the woman in which they decided that the woman’s leg needs to be amputated, a decision refused by the patient.

The woman then sought treatment abroad and she was relatively cured from pain and escaped from her leg being amputated.

A report by a forensic doctor mandated by the court showed that the surgery the woman underwent was necessary but the inflammation went out of control. The delay in removing the steel rod aggravated the problem and it led to 20 per cent disability. Based on this and other counts, the court ordered Dh200,000 in indemnity to be paid jointly by the hospital and the body in charge of running and managing the hospital as per article No 313 of the civil procedures law.
