The Abu Dhabi civil court on Monday ordered the case to be referred to establish the medical liability of the doctor who performed the surgery on the woman, who died last year — a year-and-a-half after three separate surgeries during which a medical error occurred.
The Arab woman, who was left hospital-bound after the surgeries which destroyed her wind pipe and oesophagus, filed a lawsuit while she was still alive against the hospital demanding compensation for harm and financial losses sustained due to the doctor’s medical negligence.
The case started when the woman was admitted to hospital due to severe pains she had suffered in her chest, with doctors opting to perform open heart surgery. The woman was allegedly discharged from hospital before she had fully recuperated, and she began to once again experience severe chest pain eight days later causing her to be admitted to the hospital once more.
However, during the operation a medical error occurred which led to pulmonary artery damage and a haemorrhage in one lung, while one of her kidneys also stopped functioning. The doctor resorted to another open heart surgery to stop the bleeding, making a cut along the woman’s throat to instal pipes to allow her to feed and breathe.
She remained in the hospital’s Intensive Care Unit while further work was done to correct the earlier mistakes, during which time the woman filed the lawsuit. However, one-and-a-half years after the third surgery in mid-2012, the woman died in hospital and the lawsuit was amended in the name of her son.
The son claims that medical equipment and tools used in the operation room were not sterile enough, which caused the spread of germs which aggravated his mother’s health condition.
The suit is for both the Dh9 million and the voidance of any financial obligations owed to the hospital as a result of treating her for damage sustained due to the medical error.
