A business partner accused of forging a company ownership certificate was acquitted of the charge by the Dubai Criminal Court. The Commercial Court affirmed that the certificate was genuine.
The 42-year-old plaintiff, the Jordanian ex-wife, and inheritor of the company, had accused the partner of forging the certificate in an attempt to get her brother named as manager in his stead.
Her ex-husband had hired her brother but fired him later due to general incompetence.
"In 2010, the woman and her husband divorced because of problems she had with him and his family, laying blaming on the defendant," said the Emirati Lawyer Awatif Mohammed, from Al Ruwwad Advocates.
The husband had established his company with his cousin - a 38-year-old Palestinian engineer. One year after the divorce, he gave him 25 per cent ownership of the firm.
"He also gave him a signed power of attorney in order to manage the company, which he could have used to register the entire company in his name but he did not," said Mohammed.
The plaintiff was given custody of her children, and the guardian of their inheritance - including the engineering company - following the death of her ex-husband in 2015.
"She filed a case against my client at the Criminal Court, accusing him of altering the ownership document. She filed a case with the Dubai Economic Department requesting they appoint her brother as the company's manager," said Mohammed.
The lawyer presented a witness testimony by the deceased's mother, confirming that her late son had, in fact, signed the partnership certificate and informed her personally of doing so before he passed away.
