An Emirati man, charged with raping his Uzbek girlfriend at his flat after beating her up, was sentenced to three years in jail by a Dubai court on Monday.
The Court of First Instance was told the 39-year-old accused (an employee) invited his girlfriend over on January 21, 2017, to talk about a case she had at the Naturalisation and Residency Prosecution, but there he beat her up and raped her.
According to public prosecution records, he also kicked her out of his place while she was naked and threw her clothes off his balcony in the 11th floor in Al Nahda.
She got some clothes from his Russian neighbours and went down to recover her clothes and mobile phone. She got dressed at her place and then filed a complaint against him at Al Qusais police station.
The accused, who faced rape and sexual assault charges, also received an additional six-month jail term.
The complainant, a jobless, said the defendant had bailed her out when she was detained in connection with a case at the residency prosecution. "I went to his place around noonupon his invitation. His two kids were there and he was drinking alcohol. He started shouting at them and me before he dragged me by force inside the bedroom and locked the door. He raped me there for two hours while physically assaulting me. Once done, he dragged me naked by my hair and kicked me out. He kept saying in Russian that I would not be able to do anything," she told the investigators.
The police raided the flat with a public prosecution warrant. No one was there at the time.
A police lieutenant said they arrested the accused around 1am on January 27, last year, in a room on the rooftop of a house shared by bachelors.
"The accused claimed he had been seeing the woman for one year and that she would visit him in his flat where they would have consensual sex. But on the incident day, he did not have any sexual encounter with her, he alleged," the lieutenant said.
"He said she entered the bedroom and they soon started arguing about her immigration case. He pulled her by her hair and kicked her out while she was naked as he was angry. He denied having thrown her clothes out of the balcony or beating her up."
A hallway surveillance recording showed the complainant being forced out naked of the flat and then walking to the lift. The accused was later seen going out with his kids and looking normal.
The forensic examination detected the man's DNA traces on the complainant's body which also bore bruises and scratches.
The court ruling may be appealed.
