A lower court had asked the construction firm to expedite the supplier's claim of Dh850,000 on the basis of a fax message that was used as evidence.
The apex court ruled that the fax accepted as evidence by the lower courts was not sufficient to make it imperative on the defendant company to make the payment, because it was signed neither by the owner of the establishment nor his deputy.
The supreme court agreed with the defendant's claims that under the Evidence Law unsigned cables or faxes were not legally admissible in the court.
The case has been referred to a different bench in the Court of Appeal.
