Disposing a writ petition filed by P Amina Nahna, a candidate on the rank list prepared on the basis of the common entrance test conducted by the Commissioner for Entrance Examinations, Justice Antony Dominic directed the colleges to give admission from the government rank list.
The court found that the test conducted by the association was not fair and transparent. The judge imposed a penalty of Rs525, 000 on the association for not conducting the test under the supervision of the Admission Supervisory Committee for Professional Colleges and as per Supreme Court directive.
Out of this, Rs25, 000 will go to the petitioner towards the court expenses. The rest will go to the Legal Services Authority. The court came down heavily on the government for not taking over the seats despite sufficient ground for its intervention. The judge termed the government’s approach shameful.
The court also criticised the Admission Supervisory Committee headed by retired high court judge Justice P A Mohammed for not ensuring fairness and transparency in the conduct of the entrance test. The petitioner had contended that admissions to professional courses should have been made on the basis of a competitive entrance examination as provided under Regulation 5(5) (1) of the Graduate Medical Education Regulations. The association’s test did not satisfy the provisions of these regulations, the petitioner argued.
The test had evoked strong protests from the students unions following allegations that one of the colleges under the association had collected capitation fees ranging up to Rs.5 million for admission before the entrance examination. The college, Dr Somerwell Memorial Medical College at Karakkonam, subsequently quit the association and offered to admit students to the seats under the management quota from the government rank list.
Meanwhile, association president Dr Fazal Gafoor said that the test was conducted transparently and the association would soon meet and decide the next course of action.
