A motorist, who racked traffic fines of up to Dh50,000 against the car he had bought from an Abu Dhabi resident before registering it in his name, has been ordered to clear the violations committed during the period.
The Abu Dhabi Appellate Court has cancelled the ruling by the first court that had ordered the first owner of the car to pay the traffic fines.
The judge ordered for the transfer of all the traffic fines amounting to Dh50,000 from the file of the first owner of the vehicle to that of the man who had committed the violations after he received the car from the former before registering it in his name.
Official court documents stated that the man had committed the traffic violations when the owner handed him over the car for a few days after the pair finalised the purchase agreement, but before taking the car to traffic authorities for transferring the registration licence in his name.
The first owner received notifications about traffic violations amounting to a staggering Dh50,000. He immediately went to the authorities and filed a lawsuit demanding that the fines be transferred to the defendant's traffic file as he's the one who committed them. He told the authorities that he had sold the car to the defendant and the man was driving it before transfer of registration licence. He also presented evidence of the sales agreement.
The court of first instance, however, rejected his request and ordered him to pay the fines after the motorist denied committing the violations.
The man then challenged the ruling in the appellate court. The court cancelled the first ruling based on the evidence presented by the first car owner that showed that the man actually committed the traffic violations after receiving the vehicle and before transfer of ownership.
