The Ras Al Khaimah (RAK) civil court of appeal has ordered a driver to pay Dh450,000 in compensation to an Arab woman who suffered 80 per cent disability after he ran his vehicle over her.
The RAK public prosecution pressed four charges against the 20-year-old driver, who hails from the Gulf region. These included inattentive and reckless driving, damaging other's properties, causing injuries to the victim, and driving a car with expired registration.
As per court records, the case dates back to June 2016 when the defendant ran over the 31-year-old victim who suffered serious injuries and was shifted to Saqr Hospital for medical care.
The victim was almost in coma when admitted to the hospital as the accident had impacted her brain. Part of her nose, spine, right arm, and her right ribs were fractured too.
The erring driver was referred to the traffic misdemeanour court which slapped a fine of Dh500 on him for driving a car with an expired registration, and Dh1,500 against other charges.
The victim filed a lawsuit at the RAK civil court against the defendant and his insurance company requesting a compensation of Dh3 million against her 80 per cent disability and need for a permanent helper.
The victim, dissatisfied with the Dh350,000 compensation ordered by the court, challenged the verdict before the higher court which approved her lawyer's request to get an official medical report of her condition from the Dubai Health Authority.
The medical report showed that the woman suffered an 80 per cent disability owing to her brain injury. The accident also left her unable to properly move, think or act. She could no longer carry out her previous job in a cosmetic salon.
Based on the medical report, Ras Al Khaimah civil court of appeal increased the compensation from Dh350,000 to Dh450,000, considering the fact that the victim needed permanent assistance.
