The Ras Al Khaimah Criminal Court has exonerated an Arab employer of the charges of sexually harassing a young woman whom he allegedly promised to offer a job in his company.
The court based its verdict on the contradictory statements of the plaintiff regarding the timing of the alleged harassment, while there was lack of evidence or witness in the case.
As per court records, the case unfolded when the complainant contacted the defendant to work with him.
He promised to provide her with a job, and asked her to meet him at a designated place in the emirate of Ras Al Khaimah.
The employer picked her up in his car and headed to a construction site, where he allegedly sexually harassed her. The victim pushed him back and cried. The man comforted her and asked her to keep it a secret and dropped her back home.
The woman lodged a complaint against him with the RAK Police, who arrested the man.
The man was referred to the RAK Public Prosecution and then to the court where the young woman accused him of sexually harassing her.
"I met him (defendant) as agreed at 5.30pm, and went back home at 6.40pm."
However, she changed her statement when interrogated and said she met him at a petrol station at 8.30pm.
"The investigations carried out are more or less a probable opinion that can be right or wrong, and hence there must always be an evidence to support the same," the court explained. "Otherwise, these investigations cannot be definite."
The court cannot base its ruling on indefinite investigations, and therefore, it ordered the acquittal of the defendant.
