The complainant, a 57-year-old bookkeeper, said during investigation that the defendant assaulted him when he went to the latter’s office in Rafaa in April last year to collect the money he had lent to him. He entered the defendant’s office and showed him the due bill but the accused became angry and began shouting. He declined to pay.
The complainant reminded him that he had declined to pay the bill when he came to his office two months earlier. As he was walking out and moving towards the lift to leave, he heard the defendant shouting and getting close to him. The defendant pushed and knocked him down. He tried to support him with the hand as he fell and felt that it was broken.
He told the accused about his hand’s condition and the latter pulled his hand so that it would regain its natural condition. The defendant told him to go and not come back again.
When the complainant told him that he would file a police complaint, the accused told him to go wherever he wanted. The complainant sought the help of a friend whose office was nearby to take him to a hospital.
According to the forensic medicine report, the complainant was left with a permanent disability in moving his right wrist as a result of the assault. Part of the evidence is a hospital report stating that the complainant had undergone a surgery for a hand fracture in April last year. An Iraqi businessman said that one week after the incident, he was at the complainant’s workplace when the defendant came there with two men. The defendant tried to work things out with the complainant’s brother.
The accused said that he did not mean to push the complainant and cause him to fall. He said he was willing to pay the treatment cost.
