An Arab man stood trial at the Ras Al Khaimah criminal court on charges of assaulting another man with a sword.
The victim, attacked by the defendant and friends during a fight, suffered permanent disability in one of his legs as per the forensic report.
The RAK Court of First Instance, found the defendant guilty of causing a permanent disability to the victim with the help of his friends and sentenced him to five years in jail, and deportation thereafter.
However, the victim was also convicted by the same court of assaulting, insulting and swearing at the defendant, and was sentenced to one year in prison and deportation after the end of the jail term.
Court records show that the suspect had a fierce fight with the victim for no clear reason after they got out of a nightclub. The fight ended in a permanent disability in one of the victim's legs.
The victim lodged a complaint against the defendant to the RAK Police who arrested him and referred him to court. The defence lawyer approached the appellate court claiming that the forensic report did not show the nature of the permanent disability the victim suffered.
He added that the victim refused to have an operation to fix the fractures he sustained in his leg when he was first brought to the hospital, as per the same report.
Instead, he returned two weeks later to the same hospital for treatment, but his injuries got worse and turned into a permanent disability because he initially refused to have a surgery as advised by the specialists concerned there. The defence lawyer told the court that his client did not plan or agree with other suspects to assault the victim, and even denied these charges which he said "were not proved by the police".
He claimed that the victim was the one who assaulted his client that left the site without assaulting him in return. He told the court that the police investigations were baseless as they only contained the statements of the victim and his girlfriends, and turned blind eye to his client's defence.
