Granddad in UAE gets custody of late son's daughter

Ras Al Khaimah - The widow sought the custody of her daughter, stating that she never wasted money or violated law in any way.

The Personal Status Court of Appeal in Ras Al Khaimah has upheld an earlier ruling that gave a grandfather custody of his late son's eight-year-old daughter.
The court turned down the Arab mother's request to have custody of her daughter and handed it to the grandparent entrusting him with honestly keeping, managing and investing the inheritance of the minor girl.
As per court records, the case unfolded when the father died and left behind a bequest of a house, cars, and a number of trade licences.
The widow sought the custody of her daughter, stating that she never wasted money or violated law in any way. However, the grandfather insisted on taking custody of the little girl.
The mother approached the RAK Personal Status Court which ruled in favour of the grandparent, and ordered the mother to pay court charges and advocate fees.
Dissatisfied with the verdict of the lower court, the mother challenged it in the RAK Personal Status Court of Appeal where she dubbed the earlier order "null and void".
"The ruling was based only on the pleading of the grandparent without verifying the status quo; and what if he wastes the inheritance?"
She added that she knew the needs and requirements of her daughter better. "I fully meet all conditions due for her custody."
"The grandfather did not fulfill my daughter's needs and refused to spend any money on her," she claimed.
However, the higher court upheld the earlier ruling that gave the grandparent the custody of his late son's daughter.
