Take advantage of Mission visa for change of job

Q: I work as an accountant in a private security company but the position mentioned in my visa is 'security guard'. When I asked for a change, my employer told me to pay for it. He also said that I have to work on the same visa for one full year? Is this legally sound? If I want to change my employer what should I do? Is a No Objection Certificate (NOC) required? I am on an unlimited contract and I have already completed more than 15 months of continuous service.

A: If your visa status is as 'security guard', even though you are working as an accountant you may have to continue on the same visa for a period of one year before applying for change of designation.

In respect to change of sponsorship and NOC requirement, you may have to contact the Labour and Immigration departments because rules keep changing depending on the market situation.

Q: I used to work as a civil engineer in a company. I cancelled my employment visa after completing nine months in service and the company gave me an NOC to join another company. Do you think I can get fresh employment visa in another company? I have completed five months after leaving the UAE and I am in India. Can I return and work on a Mission visa. Please advise.

A: Since your previous company has given you an NOC to join another company and you have cancelled your employment visa after completing nine months, you may get a new employment visa to work in another company. Since you are in India, I would advise you to take advantage of the short-term Mission visa so that you do not face any hassle later.

Q: I have completed three years in service with a company in Dubai. I work as a customer support coordinator. I would like to quit and look for better opportunities. When should I give notice to my company? Is it possible to shift to another job without an NOC or would I be liable to face a ban?

A: Since you have completed three years of service, you may give one month's notice to the company to leave the job, provided there is no other stipulation in the contract.
