A Science student who was dismissed by a local university for alleged misconduct, has won the legal battle over her college and can go on to complete her course.
The Federal Supreme Court in Abu Dhabi upheld earlier rulings by lower courts and cancelled the decision by the university to expel the student for alleged misbehaviour.
Official court documents stated that the Arab student at the university's faculty of science was also expelled on the added grounds of violating university regulations.
The student had filed a lawsuit against the university located in the Northern emirates, challenging her dismissal as unlawful, and stressing that there was no genuine reason for forcing her to quit her studies. She stated her surprise when the university management handed her a letter expelling her the university.
She said the university's disciplinary committee's report on her alleged misconduct - the basis for the management's decision to expel her - was false and didn't have enough supporting evidence.
The student had asked court to cancel the university's expulsion decision and force the management to take her back so she complete her science course.
She also requested for compensation from the school for the wrong dismissal, which she said not only affected her studies but also her, psychologically.
Both the First Instance Court and the Appeals Court ruled in support of the student and cancelled the university's decision to expel her. The university appealed to the UAE's top court, which has maintained the first rulings.
The Supreme Court ruled that the student has a right to challenge the university's decision to stop her from completing her course, according to the law, if she has genuine reasons and supporting evidence that she was unlawfully dismissed by the school.
