A flight attendant, who became disabled following a boat accident caused due to the captain's recklessness, has been awarded Dh70,000 in physical and moral damages.
The Abu Dhabi Civil Court ordered the captain, who was also the owner of the boat, to pay the compensation amount to the stewardess. Earlier, criminal court rulings found him guilty of causing the accident, which left the woman seriously injured.
Official court documents stated that the boat had crashed into a concrete pier at the docking area in Abu Dhabi.
The incident occurred when the woman was enjoying her leisure time on the boat that was being driven by the captain. Investigations said the accident happened due to the captain's negligence and recklessness while driving the vessel. Prosecutors said the man didn't take the necessary precaution, which resulted in the crash and left the woman's foot paralysed.
A medical report said the stewardess had suffered double fractures to her entire left foot. It required several surgeries, and the installation of supports and screws for her foot. Later, it resulted in a permanent disability, when she became paralysed and confined to a wheelchair as she could no longer walk on her own. The medical report determined the woman's disability level after the crash at 35 per cent.
The Abu Dhabi Criminal Court had earlier found the boat captain guilty of accidentally causing the crash due to negligence and the judge fined him Dh10,000. The man was also ordered to pay the woman Dh70,000 for physical or body damages. The court advised the woman to file a civil lawsuit for moral and material damages she suffered due to the crash.
The stewardess then filed a civil lawsuit against the captain demanding Dh1 million in compensation for moral and material damages she suffered. The woman claimed that she was working as a flight attendant for an airline. And because of the injuries that left her with disability, she lost her job permanently.
After hearing all parties, the civil court asked the defendant to pay the plaintiff a compensation of Dh70,000 for the physical and moral damages she suffered as per the previous court ruling. It rejected the woman's request regarding compensation for material damages.
The court said the plaintiff was not entitled for another compensation because it is not permissible to combine two compensations for the same injuries or damages.
