A foreman, sentenced to 15 years in jail for raping a cleaner in a shopping centre restroom while drunk, has lost his appeal.
In May, the Court of First Instance found the 48-year-old Indian man guilty of raping the Nepali victim, 26, after he forcibly pulled her into the changing room and slapped her.
He had consumed three bottles of whiskey before attacking the woman.
The Court of Appeals found him guilty of charges of rape and consuming alcohol without a licence, and ordered his deportation after serving his jail term.
The incident was reported on July 10, 2016, to the Bur Dubai police.
"I was in the restroom of the shopping centre at 2 am, when I saw that man's reflection in the mirror. I turned around and asked him why he was in the women's toilet," the victim said.
She tried to get out but he stopped her and snatched her mobile phone. Before she could scream further, he pulled her violently into a changing room, covered her mouth with one hand and slapped her face several times. He then stripped and raped her.
When he heard people talking outside and about to enter the toilet, the man fled. The police arrived shortly later and took her to the hospital.
They arrested the accused at 3:00pm on the same day.
"I saw the victim crying and in a very bad shape in the ambulance," a police lieutenant testified. "The accused was arrested from the parking lot, where he was hiding. He gave conflicting stories when I interrogated him. But he claimed she took off her clothes and had sex with him willingly. He also claimed he slapped her after she cursed him," the lieutenant added.
The forensic report showed the defendant's DNA traces were found on the woman's body.
The accused may challenge the court ruling within 30 days at the Court of Cassation.
