A farm worker has been cleared by a Dubai court of sexually assaulting a compatriot.
Prosecutors accused the 39-year-old Pakistani man, who is in detention, of sexually assaulting the 22-year-old victim and also touching him against his will over a span of more than a year.
He denied a charge of having forcible sex with a male at the Court of First Instance.
The court acquitted him but the ruling may be appealed by the public prosecution.
The alleged incidents began from April 2017. A complaint was lodged at Lahbab police station.
During the public prosecution investigation, the victim, a worker, said that from April last year up to October 2018, the defendant had been sexually harassing and assaulting him at their sponsor's farm in Al Aweer. "He would do it very often until one night when I was talking on my mobile phone behind a tent at the farm. It was about 10pm. I was sitting on a couch and he came to sit next to me."
The complainant recounted how the accused told him to pay back Dh250 he owed him or otherwise let him have sex with him.
"I told him I did not have that money at the time and firmly rejected his attempts. He then slapped me on my face and I reacted by pushing him," he told the prosecutor.
The complainant said that he was then aggressively grabbed by the neck and scratched by the defendant's fingernails. "I could break loose from him and I ran to my room. A Pakistani man, who then saw me, told me to wait until the morning so he could talk with the accused. But I complained to the police right away."
According to a forensic report from the general directorate of criminal evidence and criminology, the victim is not used to having sex with males.
The report also showed the victim was left with neck bruises, which is consistent with his account of what happened.
