Mother regains custody of special needs son in UAE, court turns down father's extension request
The divorced couple agreed that the father would keep the son for a period of two months, which ended on June 30.
An Arab woman has regained the custody of her special needs son after the Ras Al Khaimah Personal Status Court of Appeal turned down a request from the father to extend the young boy's custody to him.
Earlier, the Personal Status Court ordered divorce and gave the mother the custody right of all her kids.
However, the couple agreed that the father would keep the son in his custody because of the kid's lingual and verbal disorders.
As per a report issued by the People of Determination Centre in RAK, the boy did not respond to anyone but his father and was recommended to undergo a rehabilitation programme.
The parents agreed that the father would keep the son for a period of two months, which ended on June 30.
However, the father submitted a request to extend the custody of his son to him until September 2021 as medically recommended, particularly as the boy's condition improved.
The enforcement judge urged a special report to decide if the change of the boy's custody environment would affect his medical condition and if an extension of the custody is needed, and for how long.
The experts' report showed that the son has significantly recovered after staying these two months with his father. But it affirmed that the change of custody environment would have no impact on the boy who will go back to his mother and stay with his siblings.
The enforcement judge quashed the request of the father, who challenged the decision before the higher court. The court upheld the rejection ruling and ordered the custody of the recovering boy to be shifted to his mother.
