The man was charged with assault leading to death, and molestation. The Emirati defendant is believed to have punched the victim on her face which caused her to fall, hitting her head to the ground. He kept kicking her head while she was lying on the ground, injured.
The confrontation happened after he molested her friend outside a hotel on Shaikh Zayed Road. It was after 3am, one night in February. The victim’s 28-year-old compatriot friend told the prosecutor that the incident happened in the parking lot outside the hotel. She, the victim and another woman had just come out of a party at a night club and were walking towards the parking lot. The defendant approached them and started fondling and groping her. She was angry, but the defendant pushed her away. She then walked towards her car and started talking on her mobile phone. When she looked back, she saw her friend, the victim, lying on the ground and the defendant kicking her head.
She screamed for help and some passers-by came to their rescue. The defendant was in a state of rage and passers-by had a difficult time controlling him. By the time the police arrived, the accused fled the scene with his friends. The witness, however, managed to take down his car registration number.
The victim was rushed to Rashid Hospital in a critical condition. The witness added that the defendant’s companion had tried to calm him down. He even apologised for his friend’s behaviour blaming it on the influence of liquor. The other woman, a Kenyan visitor aged 29, who was with the victim that night, confirmed that the victim was assaulted by the defendant. The victim screamed at the accused after he molested her friend and so he punched her face and knocked her down. He then kicked her head many times. She saw the victim bleeding from her nose, ears and mouth.
The witness was also punched by the accused but she dropped her charges later at the Bur Dubai police station. An Egyptian security guard said he witnessed the assault. He also saw him escaping with five men in three 4WDs. According to the forensic medicine report, the death was caused by a severe head injury and skull fracture.
The victim’s head hit the solid ground which led to bleeding and severe swelling. The victim plunged into a coma after the assault and died the following day.
