Prosecution seeks death for ‘inhuman’ father

The Public Prosecution on Monday urged the Court of First Instance to award capital punishment to an Emirati father and his compatriot mistress who are accused of torturing and illegally confining the former’s eight-year-old daughter which led to her death.

At a Press conference, Dubai Attorney-General Eissam Issa Al Humaidan urged the court to impose death penalty on 29-year-old H.S., an ex-security supervisor, and his 27-year-old mistress, A.A., under Article 344 of the Federal Penal Code.

Al Humaidan said the investigation carried out by a task force from the Family and Juvenile Prosecution under the supervision of Chief Prosecutor Mohammed Rustom Bu Abdulah, concluded after reviewing the technical and police evidence, and statements of witnesses.

The two defendants were found to have used different kinds of torture on the victim, Wadeema, and her surviving seven-year-old sister, Mira. “The two defendants illegally confined and tortured the two sisters with no mercy. They were inhuman and applied mental and physical torture which caused Wadeema’s death and Mira’s injuries.”

Al Humaidan added that even though H.S. would be prosecuted for using narcotics and possessing Tramadol, it could not be confirmed whether he was under the influence of narcotics at the time of the victim’s death given that the body was discovered about six months later.

Father legally responsible

H.S. was not examined by a psychiatrist to see if he was mentally stable and he would be considered legally responsible for his acts, Al Humaidan confirmed. “Even after the death of Wadeema, due to the inhuman torture, H.S. continued abusing and torturing his other daughter, Mira, which indicated he did not show any regret for what he did.”

The forensic report could not determine the exact cause of death of the victim since the body was found in an advanced state of decomposition. It was buried in a sandy location in Al Badayer in Sharjah.

“The apparent marks of physical abuse and unhygienic conditions in which Mira was found in the studio flat rented by her father led the police to the discovery of the death of Wadeema,” the Attorney-General said. In his statements to the interrogators, H.S. said he committed the crimes against his daughters to make them obey him. A.A. claimed she was scared of H.S. and could not stop him.

Charges against the two

H.S. and A.A. would face the following charges in the court:

1.) Illegally confining the two juvenile victims and depriving them of their freedom for about six months with the use of force, threat and physical and mental torture which led to the death of Wadeema and the permanent disability of Mira. Their brutal torture ways on the victims’ frail bodies included beating with an electric shocker and electric wire, burning with iron and lighted cigarettes, and pouring boiling water on them. The confinement used to be in the bathroom or closet for hours with no water or food.

2.) Assaulting and torturing Mira, which led to 10 per cent permanent disability.

3.) Hiding Wadeema’s body by burying it without the necessary authorisation from the authorities concerned.

The prosecution would hand in the arraignment sheet to the defendants on Tuesday and refer the case later to the Court of First Instance. No date has been fixed for the trial.The two have also been referred to the Court of Misdemeanours on illicit consensual sex charge.
