According to the prosecution records, the 47-year-old Indian defendant threw a get-together in his flat to which he invited people of different nationalities. When the party was over, he found the 30-year-old jobless Filipina complainant exhausted and under the influence of liquor.

He carried her to his bedroom and tried to undress her. As she resisted him, he punched on her face and beat her up. He tried to strangle her until she lost her strength. She begged him to leave her alone but he raped her.

When he left the room, she tried to walk out but found the door locked. She fell asleep and was awakened by her friend who helped her get dressed. They went to a hospital and filed a complaint at the Bur Dubai police station the next day. The complainant’s 34-year-old Filipina friend told the prosecutor that she woke up in the morning that day but did not find her friend next to her on the couch. She asked the defendant about her friend twice and at each time, he told her to wait. Shortly later, she found scratches on his hand. He told her that he had a fight with her friend the night before.

She entered a room and found her friend lying naked and motionless on a bed. There was blood and bruises on her head and body. She woke her up and her friend looked afraid and began crying. A policeman said that the two women reported the incident in the afternoon of a day in February. When arrested, the defendant claimed that he had consensual sex with the Filipina. He also alleged that she was a prostitute and came to his house upon his request.

The forensic report said the woman had bruises and scratches on her face, arms, back and knees, which could result from a fight.
