Two expatriate foremen, who abused their position and illegally signed a subcontract with a third party after forging their employer’s official documents, have been sentenced to six months in jail each to be followed by deportation.

According to court records, the two, who had authority over the workers, made them work on a different project. The scheme came to light when an engineer associated with the parent company called up the manager of the company to ask why workers were missing at the work site.

When the manager rang up one of the men to ask why they had not reported for duty, the worker told him that the two foremen had taken them to another site to work there. He also informed the manager that this had been going on for a week.

The manager discovered an illegal subcontract had been sealed with the company’s stamp. He then reported the matter to the police, who arrested the two and referred them to the public prosecution.

The Abu Dhabi Criminal Court found the foremen guilty .

Compensation battle

After the criminal court’s verdict, the company sued the duo in the civil court, demanding Dh2 million in compensation.

The civil court delegated an engineering expert to assess if the company had suffered any loss and the expert reported that there was no proof that the duo had used the company’s resources or used its 34 workers to do their other work.

The report said only two workers were exploited for one week and the wages of the two workers for the time was only Dh817.Accordingly the court ordered the two foremen to pay the company only Dh817 in addition to litigation expenses.
