Complainant made up rape story: Defence lawyer

Defence lawyer Saeed Al Guilani, arguing in the Court of First Instance on a case in which a 29-year-old unemployed Emirati man is accused of kidnapping and raping a woman compatriot in his car in the desert, said the forensic report showed that the complainant had several sexual relations prior to the incident.

“She made up the whole story to cover up her shameful conduct in front of her parents. Besides, she claimed that the defendant hit her on the head shortly after riding in his car. Why would he do that given that they were lovers and going on a pleasure ride?” he asked.

Meanwhile, a forensic doctor, an Egyptian woman, told the court that the absence of struggle marks on the body of a woman complainant did not necessarily suggest that she was not raped, given that her examination was conducted 20 days after the alleged incident.

The complainant, a 24-year-old jobless, said the defendant picked her up from the Global Village to talk about their marriage on February 27.

The Emirati defendant allegedly fooled his compatriot saying he wanted to get to know her before proposing to her and accordingly she rode in his car. He then took her to a desert location in Al Rowayah area on Dubai-Al Ain Road where he raped her.

“I felt scared when he drove on Dubai-Al Ain road but he said he wanted to show me his parents’ farm,” she recounted in the investigation.

Her fear grew when he stopped in a dark location and she told him to drop her back. But to her shock he began touching her body. She said she had a shoulder condition and could not push him away.

Al Guilani added that the complainant withdrew her complaint during the investigation. “She accused my client of a crime which bears death penalty. How could she drop her accusations while claiming she lost her virginity because of what my client allegedly did?”

The lawyer also argued that the complainant washed the clothes she wore at the time of the incident instead of giving them as evidence.

A policeman, who interrogated the accused, quoted him as saying that he had consensual sex with the complainant three times.

A letter from a hospital said that the complainant had infections when she visited the hospital in March as she suffered from pain. Verdict on the case is expected soon.
