Bribery case: Mizin ex-CEO acquittal verdict upheld

The Court of Appeal upheld on Sunday the acquittal verdict given by a lower court to a former top executive of real estate developer Mizin, of the charge of taking about Dh2 million in bribes from an engineer.

The engineer has also had his acquittal upheld of the charge of receiving purchase discounts adding up to Dh49 million. The appellate court also dismissed the civil lawsuit.

The Court of First Instance in June found Mizin’s ex-CEO, 53-year-old Emirati S.H., not guilty of the charges of breaching the company’s policy and abusing his powers during his tenure in 2006-2007. He has been acquitted of having granted his accomplice, a Lebanese engineer J.H., some facilities and privileges, including staggered payment of installment and less down payment, without overcharge, in return for alleged bribes. S.H. had pleaded not guilty.

J.H. has been accused of bribing S.H. to avail discounts and facilities when purchasing land and built-up units. He had earlier denied conspiring with the ex-CEO to serve their mutual interests while damaging the company’s standing.

Since the case was referred to court in 2008, it has been examined by two different court benches.

The Presiding Judge Mohammed Jamal Kamel had assigned a committee, comprising independent and credited audit experts registered with the Dubai Courts, to examine the Mizin case and look into the relevant documents. The two defendants were acquitted as the committee’s report found that their stand was clear.

Counsel Samir Jaafar, who was representing S.H., earlier presented his defence arguments calling for the acquittal of his client of any wrongdoing. “The committee’s assignment was to determine whether the prices of the plots, subject of the dispute, matched with those fixed in Mizin’s internal lists and regulations,” Jaafar earlier told Khaleej Times. The verdict remains subject to appeal at the Cassation Court.
