In an eight-page resolution, State Prosecutor Hazel Decena-Valdez found sufficient basis to indict Magdaleno Pena for alleged violations of Anti-Violence Against Women and Their Children Act.

A bail of 24,000 pesos was recommended for Pena. Recto had earlier this year accused him abducting their 15-month-old son. Pena stands accused of maltreating the complainant. He denied the charges which occurred while the two were dating sometime in June last year.

Pena claimed Recto suffered her injuries while she was trying to assault him. He said he pushed the actress away from him repeatedly to protect himself from her attacks and during this time, she fell down on the floor. Pena said he then entrapped her under a rattan chair which calmed her down.

The prosecutor said Penas admission strengthened the claim of the actress that she suffered injuries from the hands of the respondent.

"His claims that it was the complainant who gave him a deluge of fist and kick blows, with no less than an armoured motorcycle boot, does not hold water," Valdez said, noting that Pena did not submit himself to a medical examination in order to document the injuries he sustained, if indeed there were any.

"The spontaneity on the part of the complainant in immediately reporting the incident to the authorities and submitting herself to a medical examination bears witness to her claims that the respondent maltreated her," the prosecutor stressed.
