Two given jail for indecent assault

DUBAI — The Dubai Court of Cassation has upheld the Court of Appeal's verdict and sentenced two Azerbaijan nationals, Hulia Assilman and Nazir Gul, to six months in jail to be followed by deportation for indecent assault.

As it transpired, in January 2005 a policeman found the two accused in a parked car in an isolated and place in Al Rashidya committing an indecent act.

The two of them were brought to the Al Rashidya Police Station and placed under arrest. On being questioned, both of them confessed to the crime. Forensic tests confirmed the presence of semen on their clothes.

In May 2005, the two accused appealed and claimed that the arrest was illegal. They said somebody had broken into their car. They also said that under Shariah law adultery (sodomy) should be proved by four witnesses and not by a single person as it had happened. They also claimed that the medical report was false, and that during their trial there was no translator.

The court rejected the appeal. It said that during the investigation by the Public Prosecution, they had been provided with the services of a translator. Besides, they had also confessed to the crime. And that during the court trial, it was the defence that did not ask for a translator.
