SMS leads to divorce

ABU DHABI — The Federal Supreme Court has granted divorce to a wife who received an abusive SMS message on her cell phone from her husband. Earlier, the wife had filed a lawsuit in the Abu Dhabi Sharia Court of First Instance, demanding a divorce on these grounds. The husband had at that stage admitted he sent her the offensive SMS. But the Sharia court refused to grant divorce because the couple had children who required the care and attention of both parents.

The wife contested the verdict and filed an appeal before the Abu Dhabi Court of Appeal, which upheld the previous court’s ruling and denied the divorce.

Undeterred, the wife filed an appeal before the Federal Supreme Court arguing that the abusive language her husband had used and the fact that he had confessed to it, were sufficient grounds for her being granted a divorce. The Federal Supreme Court, stipulating a wife is entitled to a divorce in such a case, eventually granted her the divorce.
