ABU DHABI — The Federal Supreme Court has annulled an earlier judgment passed by lower courts, ordering a woman to return her baby to her former husband, who is currently staying in another Gulf country.
Court records show that the father filed a lawsuit at the Abu Dhabi Court of First Instance against his former wife, working in Abu Dhabi, demanding that their baby be returned to him in his home country in order to have a passport issued for him.
The Abu Dhabi Court of First Instance ruled in favour of the man, asking his ex-wife to return the child to his father. The woman moved the appellate court which also issued the same verdict.
The mother moved the Federal Supreme Court, contending that she was still breast-feeding her one-and-a-half-year-old baby and hence, it was imperative that her child stayed with her during this period.
