No attempt to scrap labour ban: ministry

ABU DHABI — The Ministry of Labour and Social Affairs has no plans to scrap the ban on expat workers who are found violating the labour laws of the country. Denying rumours that the Ministry will or do away with the ban, Dr Khalid Mohammed Al Khazraji told Khaleej Times that the labour authorities will not remove the ban on employees in case of violating certain labour laws.

According to Article No. 128 of the Labour Law, when an employee leaves his work without a valid reason before the expiry of the contract from a limited period, he may not, even with the employer’s consent take up other employment for one year from the date on which he left his work. It shall not be lawful for any employer who is aware of the fact to recruit such a worker or keep him in his service before the expiry of such period.

“It is just a rumour and has nothing to do with the measures adopted by the Ministry to streamline the labour market”, Al Khazraji, said yesterday, responding to a question if the Ministry had any intention to discard the ban imposed on employees in case of violating certain articles stipulated by the labour law. Hs also added that the Ministry is the sole authority responsible for implementing the ban, according to the provisions of the labour laws and regulations.

“Neither the firms nor the sponsors, have the right to impose a ban on the employees. The Ministry is the concerned authority for enforcing this rule in its capacity to recruit and employ foreign labour force”, reiterated Al Khazraji.

He said the ministry is committed to implement the ban, which is one of the laws that helps regulating the labour market, noting that this ban is different from that implemented by the Immigration and Residence authorities on expatriates in case of violating residence laws. The Ministry will implement the ban on employees if on completion or termination of his contract for any reason, the employee will compete with his ex-employer or participate in any projects within the UAE.
