Man convicted for driving under infuence of drugs

ABU DHABI — The Federal Supreme Court has sentenced Ghulam Mohamed Sultan, convicted of driving under the influence of narcotic drugs, to two months in jail and a fine of Dh500. His driving licence has also been impounded.

Interestingly, it was stated in court that he was taking these drugs as per the prescription of a qualified neurologist.

Court records also highlighted the fact that Ghulam Mohamed Sultan was fully aware of the tranquilising effect of the prescription drugs he was taking. However, he was accused of driving his car recklessly.

The Public Prosecution accused him of recklessly driving his car in Sharjah, while still under the influence of the powerful prescription drugs. He was also charged with unintentional damage of property and failing to provide any justification for not reporting these accidents to the nearest police station.

The Sharjah Traffic Court sentenced him to two months in prison, slapped him with a fine of Dh500, and forfeited his licence for three months. The accused moved the Sharjah Court of Appeal, which dismissed his petition, and upheld the earlier judgment.

The accused subsequently approached the Federal Supreme Court, denying the onus of any responsibility for his minor accidents and consequential damage to property. He argued these occured while he was under the influence of prescribed medication.

In reply, the apex court pointed out that the convict was fully aware of the medication's sedative influence — but he failed to take any precautionary measures and instead chose to drive his vehicle recklessly. The apex court turned down his plea and upheld the verdict of the lower court.
