Man attempting re-entry during ban period fined and deported

ABU DHABI — The Supreme Court has ordered the deportation of a foreigner who tried to re-enter the country during a temporary ban period imposed upon him by the Sharjah Court of Appeal.

The Public Prosecution accused Shaheen A. of attempting to re-enter the country despite the ban issued against him after he was deported.

The prosecution stated that the man did not obtain any special permit from the Minister of Interior to re-enter the country during the temporary ban period, so it demanded of the court to punish him according to articles 1, 28, and 31 of the Federal Law No. 6 for the year 1973, which was amended by the Federal Law No. 13 for the year 1996, regarding the residency and entry of foreigners in the country.

However, the Sharjah Court of First Instance issued a verdict ordering the defendant to pay a fine of Dh500, in addition to deportation, but he appealed against the verdict before the Court of Appeal, which issued an annulment of the previous verdict and decided to fine the suspect Dh500.

The Public Prosecution filed an appeal before the Supreme Court, arguing that the appeal verdict was in contradiction with the mentioned law, and therefore it should be considered void.

Being satisfied with the argument of the Public Prosecution, the court stated that because the Court of Appeal did not comply with the federal law regarding entry and residency of foreigners, it recommended that the verdict be partially annulled, by adding a deportation order to the verdict issued against the defendant.
