Insurance firm to pay Dh50,000 in damages

RAS AL KHAIMAH — The RAK Court of Appeal yesterday upheld a ruling of the Court of First Instance ordering an insurance company to pay Dh50,000 as compensation to a man injured in a traffic accident. The defence plea to reduce the compensation amount was turned down.

The man suffered serious fractures and injuries to his spinal column and left shoulder that resulted in 7 per cent disability.

The Appeals Court also overruled the defence plea that the accident took place because of the victim's mistake as he had tried to cross the road in an area where there are no zebra crossings or traffic lights. The defence lawyer also said the driver didn't expect to encounter any pedestrian in this part of the road because of construction activity nearby and temporary street blockades.
