Grandmother gets custody of girl

ABU DHABI — The Federal Supreme Court has upheld the right of a grandmother to be the guardian of a baby girl even though the child's mother had given up her right to her divorced husband.

According to the court records, the grandma Noora Massoud had filed a lawsuit at Al Ain Shariah court against the divorced couple Fahad Abdul Aziz and her daughter Safya Saleh demanding that the court protect her right to the guardianship of her granddaughter Aiysha. The mother had given up her right for nurturing her to her divorced husband, and the biological father of the girl.

In her argument, she said she is the grandmother of the child from her mother's side, and she has more right than her father in looking after her.

Al Ain Shariah court made it mandatory on the girl's father to hand his child to her grandmother.

The court also ordered him as well as his the ex-wife to pay the fees and expenses.

The mother of the girl contested the verdict and appealed at Al Ain Court of Appeal, which refused to accept her plea because it was submitted after the expiry of the legal grace of period set for appeal. The father of the girl, however, contested the ruling at the apex court, which dismissed his petition and upheld the verdict of the court of appeal, which favoured the grandmother.

The court also confiscated the amount of deposit the man had paid when he contested the ruling.
