Freedom at last for prisoner after diya is waived

DUBAI — A youth from a Southeast Asian country, who was in prison for almost 18 months after the completion of his one-month jail term because of his failure to pay blood money in a car accident, has been freed after intervention by the Human Rights Care Administration of Dubai Police.

The youth had been ordered to be jailed for a month and had been fined Dh150, 000 for causing the death of a child in a car accident.

After having served the jail term, the youth was unable to pay the blood money (Diya). Then began the long wait for freedom. Unable to come up with the required blood money, he waited for one and a half years behind bars, said Ali Mohammed Ali, the head of the Human and Social Services at the Human Rights Care Administration.

Mr Ali said the man was ordered released after a diya waiver was obtained from the child’s father, who no longer wanted the blood money.

“We have spared no effort in helping the youth, since we received a request from his mother to help”, said Mr Ali.

He explained that officials had a glimmer of hope that the solution would come from the child’s family. “After several visits, we were able to convince the child’s father, who enjoys a good financial position, to forego the diya money. The family had, in the past, refused to do so and had insisted that the youth be punished for the tragedy,” he said.

The official said the case was one of many that had been resolved by the Human Rights Care Administration. He said the administration that operates under the general Directorate of Community Service was doing its best with available resources.
