Cyclist loses compensation appeal: award slashed in half

FUJAIRAH — The Fujairah Court of Appeal has reduced compensation granted to an Indian expatriate, ruling he was partly to blame for the road accident that crippled him.

The insurer had been ordered to pay Dh1,300, 000 compensation to a cyclist, Basubiban Bila, 37, who was hit by a car on a Fujairah road.

The accident left Bila an invalid with no control over his bodily functions. He filed a lawsuit against the insurance company demanding compensation of Dh3,400, 000.

The Court of First Instance ordered the insurer to pay compensation of Dh856, 000 to Bila. But Bila took the case to the Court of Appeal to get the amount raised. The insurance company then counter sued to reduce the compensation award.

The Court of Appeal on Wednesday found the victim had to share responsibility, since he had not checked the road before crossing. The court slashed the earlier compensation claim by nearly 50 per cent. The insurer now has to pay Dh500, 000 in addition to Dh150, 000 for medical bills.
