Court upholds acquittal verdict in expired milk repackaging case

DUBAI — The Dubai Court of Cassation yesterday upheld the retrial verdict of the Court of Appeal, acquitting two persons from charges of repackaging expired powdered milk in smaller packets with new expiry dates.

As per court records, the Public Prosecution had charged Mahdi Mohammed Hassan Hosni and Ghulam Abbas Mohammed, owners of a storehouse from where the packets were seized, with tampering with foodstuff on October 29, 2005.

When the case came up before the Dubai Court of First Instance, defence lawyer Sameer Jaafar argued that the procedures of inspection, the seizure of milk packets, lifting of samples and the sample analysis itself were null and void.

The court, on April 24, 2006, convicted the duo. The ruling was confirmed by the Dubai Court of Appeal on November 27, 2006.

The defendants moved the Dubai Court of Cassation, which on February 5, 2007, quashed the verdict and sent it back to the Court of Appeal for a fresh trial.

Though the Court of Appeal, on December 10, 2007, acquitted them, the Public Prosecution challenged the judgement before the Dubai Court of Cassation which yesterday dismissed the petition and upheld the acquittal.
