Court frees drug addict

ABU DHABI — The Supreme Federal Court has upheld the verdict of the Appeal Court exonerating a UAE national despite his confession of drug abuse and the report of the Criminal Lab that found hashish traces in his urine sample.

The apex court confirmed the Appeal Court ruling which had quashed the verdict of the Dhafra Shariah Court of First Instance sentencing the accused to four years in jail on drug charges, on the ground that the judicial officer had unlawfully taken the urine sample from the man who was initially charged with trading in firearms and ammunition.

The case opened when the public prosecution accused the national, Tawfeeq I, of abusing a narcotic drug which later proved to be hashish. Besides, three unlicensed firearms and several bullets were found in his possession. Therefore, the prosecution prayed that he be penalised in consonance with the rulings of Islamic Shariah, and related Articles of the Federal Penal Code No. 11/1976.

The Dhafra Shariah Court of First Instance sentenced the accused to four years in prison, and ordered the confiscation and destruction of the contraband. The accused contested the verdict at the Abu Dhabi Court of Appeal, which annulled the verdict of the lower court and freed the defendant on the ground that the judicial officer violated the legal procedures of judiciary investigations.

The Prosecution, however, approached the Supreme Federal Court contending that the defendant had been convicted of drug abuse relying on both his earlier confession and the report of the Criminal Lab.
