Q: My brother obtained the necessary approval from the Ministry of Labour on sponsorship transfer. But his current employer does not have a computer card at the Ministry of Labour. The company's trade licence has expired three years ago. Besides, the company's ownership was changed from one employer to another. We got signature from the new sponsor who has not yet initiated the computer card with the ministry. And accordingly the ministry is not accepting this. The old sponsor is not available for signing on the approval. How we can solve this issue?

Answer: The situation of the current sponsor is that the company does not have a valid licence and was transferred from one owner to another. This gives the right to the worker to seek the ministry's support and get sponsorship transfer. The worker, however, has to finish his relationship with his sponsor and should submit his resignation in writing and work during one-month notice period.

Q: A Muslim from Pakistan, I have divorced my wife and the case is pending in the courts in Pakistan. Now I want to marry a divorced woman from Pakistan who is now in the UAE on a visit visa. Kindly give me your advice regarding requirements and procedures for this marriage. Further, she is having a 12-year-old daughter. Will I be able to get UAE residence visa for the daughter? I am working in a semi-government organisation and entitled to family sponsorship according to the amount of the salary I earn.

Answer: Since you are eligible to sponsor a family in accordance to the salary structure and rules, and since you have a document proving that you have divorced your first wife and regardless of the case filed in Pakistan, you will be able to obtain a residence visa for the new wife. However, you are not entitled to sponsor the daughter of the new wife since the daughter is not yours.

Job title

Q: I am a holder of a B.Com degree and work as an accountant in a general maintenance establishment in Abu Dhabi, but the occupation in the visa as stamped on my passport is a private car driver in a company owned by a UAE national.

Now I have got an offer in another company as an accountant and my current sponsor is ready to give me a no-objection letter. How can I change my private driver visa to a labour visa without a ban.

Answer: You are entitled to join a new job since you are a holder of a bachelor's degree against a new contract where the exact job title should be mentioned. You should ensure that your current visa is cancelled without a ban stamp. — Compiled by Eman Al Baik
